Article 1. Shop Owner

2. The company is registered in the Polish Central Business Activity Registration and Information System (CEIDG).

Article 2. General provisions
1. These regulations define the rules of using the online shop available at www.imolatuning.com
2. To place an order, the customer must read these regulations and accept their provisions when placing the order.
3. The business activity of the shop is selling car tuning parts and car accessories.
4. The shop is available in four language versions: English, Italian, German and French.
5. We ship orders to the countries specified in the “Shipping” tab.
6. All products offered by the shop are brand new and free from physical and legal defects.
7. In order to use the shop, the customer should have active e-mail account and a device with Internet connection, meeting the following minimum technical requirements:
a. Web browser: Internet Explorer 8.0 or higher, Mozilla Firefox 4.0 or higher, Google Chrome 10.0 or higher, Opera 10.0 or higher, Safari 5.0 or higher - enabled for “cookie" files
b. minimum screen resolution of 1024x768 pixels.

Article 3. Placing orders
1. All prices quoted in the shop are gross prices and are given in EUR and GBP. Prices do not include shipping costs.
2. Orders may be placed via the shop’s website or by e-mail.
3. Orders for products available from the shop catalogue can be made 24 hours a day, 7 days a week throughout the year.
4. To place an order, it is necessary for the customer to complete an order form including full shipping address, mobile phone number and e-mail address.
5. When these data are incomplete, the shop service shall contact the customer in order to complete the information. If contact with the customer is impossible, the shop has the right to cancel the order.
6. When placing an order, the customer may use one of two payment methods: bank transfer or PayPal electronic payment system.
7. In case of parcels weighing up to 1 kg inclusive, the customer may choose one of the two delivery methods: by parcel post or by GLS courier service. Parcels weighing more than 1 kg are sent only via GLS courier service.
8. After placing an order, the customer shall receive an automatic reply from the shop, confirming that the order has been accepted.
9. The order is forwarded to processing at the time of receiving payment from customer.

Article 4. Costs and time of delivery
1. All prices quoted in the shop are gross prices and are given in EUR and GBP.
2. The prices quoted in the shop do not include shipping costs. The shipping costs are to be covered by the customer.
3. In case of delivery to a country or territory which is not a member of the EU Customs Union, the prices quoted in the shop do not include customs duties applicable in the customer’s country. Customs duties applicable in the customer’s country are to be covered by the customer.
4. The shipping fees depend on the parcel weight, country of destination and method of delivery chosen by the customer. The shipping costs are available at any time in the “Shipping” tab.
5. In case of parcels weighing up to 1 kg inclusive, the customer may choose one of the two delivery methods: by parcel post or by GLS courier service. Parcels weighing more than 1 kg are sent only via GLS courier service.
6. The weight of the parcel with the goods is indicated in the product description. When ordering larger quantities of products, the shipping cost is calculated based on the total weight.
7. The total cost of order, including the prices of ordered products and shipping costs, is indicated on the site of the order – in the basket, before clicking the button confirming the order and after choosing the products, country of destination and method of delivery.
8. The binding price is the price quoted in the online shop at the time of placing the order by the customer.
9. The goods are sent to the shipping address indicated in the order form. The shop shall immediately inform the customer of incorrectly completed order form which makes it impossible to send the goods or may delay it.
10. Orders are processed immediately and not later than within 30 days from the date of order and payment by the customer. The approximate time required for the goods to be ready for dispatch is given in the description of each item, and the approximate shipment time for each country and method of delivery is given in the „Shipping” tab.
11. Upon the receipt of goods, please always check the parcel’s contents in the presence of the courier, even if the parcel does not bear any visible signs of damage. If necessary, write a damage report and notify the shop of this situation.
12. In the event of finding damage of the goods, the customer should first report it to the postal operator / courier service. Claim for improper performance of a postal service shall expire upon the receipt of a parcel without reservations, unless the loss or damage to the goods not visible from the outside of the parcel were found by the customer after the receipt of delivery, and the customer notified the postal operator / courier service of such a claim within 7 days from the date of receipt of delivery and proved that the loss or damage to the goods arose during transport. Then, the customer should submit a complaint to the postal operator / courier service. The customer has the right to direct claims for damaged goods to the shop as well.
13. If the shop is unable to process an order due to the lack of ordered goods in stock, it shall immediately, and not later than within 14 days from the date of order, notify the customer of this fact and return the entire sum of money in case the customer has already paid for such goods.
14. Delivery of goods to the customer is synonymous with the fulfilment of order.

Article 5. Payments
1. Each transaction is confirmed by a receipt or bill.
2. Payments for the ordered goods can be made via PayPal electronic payment system or a bank transfer to the bank account of the shop.
3. The customer should make the payment within 14 days from the receipt of order confirmation from the shop. In case the customer fails to make the payment within that period, the contract shall be null and void.

Article 6. Withdrawal from the contract
1. The customer has the right to withdraw from the contract without giving any reason within 14 days from the receipt of goods by sending an appropriate declaration by e-mail or regular mail to the shop address. To meet this deadline, it is enough to send the declaration before the expiration of such deadline.
2. The right to withdraw from the contract does not apply to the goods manufactured after placing an order, directly for customer's order.
3. In the event of submitting a declaration of withdrawal from the contract, the customer shall be obliged to return the purchased goods to the shop. The return of the goods should be made immediately and not later than within 14 days from the date of submission of the declaration of withdrawal.

4. The costs of returning the goods shall be covered by the customer.
5. The shop shall make a refund using the same payment method as used by the customer, i.e. a bank transfer or PayPal electronic payment system.
6. The refund shall be made within 14 days from the date of receipt of the declaration of withdrawal from the contract but not sooner than upon the receipt of the returned goods or a proof of sending the goods back, whichever occurs first.
7. The refund shall be equal to the price of the goods returned increased by the cost of the cheapest delivery method of the appropriate goods as offered by the shop.
8. The customer shall be responsible for the decrease on value of items as a result of using them in a way that is beyond necessary to establish the nature, characteristics and functioning of these items.
9. In the event of withdrawal from the contract, it shall be deemed null and void.
10. The declaration form of withdrawal from the contract is available HERE. This form is only an example and its content is not binding for the customer.

Article 7. Complaint procedure
1. The warranty may only be maintained on condition that the installation of the purchased items is made in a professional automotive workshop. The shop is not responsible for any defects or damage resulting from improper installation. Before painting, check if the items fit the car and prepare them to be painted, unless it is stated in the product description that the items are ready to paint.
2. A complaint regarding non-compliance of the goods with their descriptions or mechanical damage to the goods received should include information necessary to identify the customer, the goods being the subject of complaint and a description of the subject of complaint. Also, for the complaint to be considered, it is necessary for the customer to provide photographic documentation confirming the subject of complaint.
3. The complaint should be submitted in writing via e-mail or regular mail to the shop address.
4. The complaint shall be considered by the shop within 14 days of its submission.
5. In case of considering the complaint in favour of the customer, the shop shall repair the defective items or replace them with new ones, or if replacement is not possible, make a refund for the defective items to the customer within 14 days from the date of considering the complaint.

Article 8. Refund policy
1. Refunds are made by the shop using the same payment method as used by the customer, i.e. a bank transfer or PayPal electronic payment system.

Article 9. Privacy and cookie policy
1. While accepting these regulations, the customer agrees to the processing of the customer’s personal data by the shop in accordance with the Polish Act on Personal Data Protection of 29 August 1997 (Polish Journal of Laws 1997, No. 133, item 883 as amended). The action of providing personal data is optional, but a failure to provide them or to agree to the processing thereof may make it impossible to fulfil an order.
2. Personal data shall only be used for the purposes of processing the order placed and settlement of transactions, including shipping the goods, invoicing or billing and financial reporting.
3. Customer data shall be confidential and shall not be used for marketing purposes or disclosed to third parties, except those responsible for the delivery of the purchased goods to the customers and those conducting financial reporting of the shop.
4. Customers shall have the right to access their personal data, correct them and delete them from our database.
5. The set of personal data processed by the shop is reported to the Polish Chief Inspector of Personal Data Protection (GIODO).
6. Our shop system uses technology to track the patterns of behaviour of visitors to our site for statistical purposes and website personalization settings. This include using a "cookie" files which are stored on your browser. You can change settings of your browser to prevent this happening and delete cookie files. If you disable cookies, you will be able to use the shop, but some of its functionality may be not available.

10. Final provisions
1. In matters not regulated by these regulations, the provisions of the Directive no. 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on Consumer Rights, of the Polish Consumer Rights Act of 30 May 2014 (Polish Journal of Laws 2014, item 827) and of the Polish Civil Code of 23 April 1964 (Polish Journal of Laws 1964, No. 16, item 93 as amended) shall apply.
2. All disputes shall be settled by a competent court specified according to the provisions of the Polish Code of Civil Procedure of 17 November 1964 (Polish Journal of Laws 1964, No. 43, item 296 as amended).
